Terms and Conditions (GTC)

1. Basis of Agreement

The preparation and performance of the show are based on the booking confirmation and these Terms and Conditions.

Individual agreements in the booking confirmation shall take precedence over these Terms and Conditions.

Any amendments must be confirmed in writing.

2. Fee and Payment

Unless otherwise agreed, the fee is payable as follows:

50% in advance and 50% within 7 days after the event.

All prices are exclusive of VAT unless otherwise stated.

3. Liability

The artist shall only be liable for damages caused intentionally or by gross negligence.

In case of slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage.

Liability for injury to life, body or health and mandatory statutory liability remains unaffected.

The organizer is responsible for the proper execution and safety of the event and shall indemnify the artist against all third-party claims.

The organizer is liable for loss, theft or damage to the artist’s equipment at the event location.

4. Cancellation / Interruption / Force Majeure

If the organizer fails to fulfill contractual obligations or if the performance is significantly impaired or impossible due to circumstances within the organizer’s responsibility (e.g. safety issues, disturbances, insufficient technical setup), the artist is entitled to withdraw from the contract or interrupt the performance.

In this case, the agreed fee remains payable.

If the performance cannot take place due to illness, force majeure or circumstances beyond the artist’s control, the obligation to perform shall cease. Costs already incurred shall be reimbursed.

In the event of cancellation by the organizer, the agreed fee remains payable.

If a suitable replacement is provided, any contractual penalty shall not apply.

5. Copyright and Usage Rights

Photo and video recordings of the performance may only be published with prior coordination with the artist.

If recordings are made by the organizer or third parties commissioned by the organizer, the artist shall receive these recordings for unrestricted use.

The artist is entitled to create and use own recordings of the performance.

All props, technical equipment, concepts and artistic content developed or created במסגרת the engagement shall remain the property of the artist, even if costs are covered by the organizer.

6. Copyright Fees (GEMA / KSK or equivalent)

Any applicable copyright fees or social security contributions shall be borne by the organizer where required by law.

7. Safety and Organization

The organizer is responsible for compliance with all safety regulations and for the proper organization of the event.

All permits, insurance and official requirements are the responsibility of the organizer.

8. Amendments

Any amendments or additions must be made in writing.

Verbal agreements are not valid unless confirmed in writing.

9. Severability

If any provision is invalid, the remaining provisions shall remain unaffected.

10. Data Protection

Personal data will be processed solely for the purpose of fulfilling the contract and in accordance with applicable laws.

11. Governing Law

This agreement shall be governed by the laws of the Federal Republic of Germany.

General Terms and Conditions (Julius Frack SHOP)

1. Scope

These Terms and Conditions apply to all orders placed via our online shop in their version valid at the time of the order.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By placing an order, the customer submits a binding offer to conclude a purchase contract.

The contract is concluded when:

an order confirmation is sent by email, or
the goods are dispatched

4. Prices and Payment

All prices include statutory VAT.

Shipping costs are shown separately during the checkout process.

Payment is made using the payment methods offered in the shop.

5. Delivery

Delivery is made to the address specified by the customer.

Delivery times indicated in the shop are non-binding unless expressly agreed otherwise.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Warranty

Statutory warranty rights apply.

9. Special Notice on Magic Products

Some products contain specialized methods and proprietary content from the field of magic.

Products may be delivered sealed. If the seal is removed after delivery, the right of withdrawal may no longer apply.

This applies in particular where opening the product reveals protected methods or confidential content.

10. Governing Law

The laws of the Federal Republic of Germany shall apply.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which:

you or a third party designated by you takes possession of the goods.
